Membership Agreement & Terms of Service

1. ACCEPTANCE OF TERMS
This Membership Agreement ("Agreement") governs the relationship between Fitinsane ("Company") and the individual accessing our services ("Member"). By registering an account or purchasing any coaching services or physical products, you acknowledge that you have read, understood, and agreed to be bound by these terms.
2. HEALTH & MEDICAL DISCLAIMER
Fitinsane is not a medical organization. The programs provided are for informational and educational purposes only. You expressly agree that you have consulted a physician before starting any physical exercise program. You are solely responsible for the accuracy of the health data provided. Fitinsane shall not be held liable for any injuries or damages resulting from the use of the programs.
3. SCOPE OF DIGITAL COACHING
All coaching services are delivered via the Fitinsane App. Training and nutrition plans are delivered within 1 to 7 business days following the submission of accurate user data. Ongoing communication is facilitated via integrated digital channels, including WhatsApp. Timely and accurate data entry is essential for the efficacy of the personalized programming.
4. INTELLECTUAL PROPERTY
All training methodologies, nutritional guides, and digital materials are the exclusive intellectual property of Fitinsane. These materials are licensed for personal, non-commercial use only. Distribution or sharing of this content with third parties is strictly prohibited.
5. PHYSICAL PRODUCTS & RETURNS
For activewear and accessories, legal return and exchange periods apply (14 days for EU residents). For Digital Services, the right of withdrawal expires once the performance of digital coaching has begun with your prior express consent, pursuant to global consumer protection laws.
6. DATA PRIVACY & GDPR
We process your personal and health data in accordance with the General Data Protection Regulation (GDPR). Your data is encrypted and used solely for service delivery. You consent to communication via encrypted channels for service-related updates.
7. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without regard to its conflict of law provisions.
